Print-on-Demand Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PRINT-ON-DEMAND SERVICES. BY USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

Definitions

For the purposes of these Terms and Conditions:

  • "Service" refers to Storybee's print-on-demand functionality
  • "Content" means any AI-generated stories, illustrations, and associated materials
  • "Print Materials" refers to physical books and products created through the Service
  • "Platform" means Storybee's website, applications, and related services
  • "User" refers to any individual or entity utilizing the Service
  • "Print Partners" means third-party vendors providing printing services
  • "Generated Content" means stories and illustrations created by Storybee's AI system

1. Intellectual Property and Content Generation

1.1. Content Ownership

In accordance with applicable intellectual property laws and Storybee's established Intellectual Property Policy:

a) Storybee maintains exclusive ownership of:

  • All AI models, algorithms, and generation systems
  • The underlying technology and methodologies
  • Platform infrastructure and proprietary systems
  • Brand assets, trademarks, and associated intellectual property

b) The AI-generated stories are licensed to users under Storybee's proprietary license, subject to the terms herein

c) Users retain ownership of:

  • Input prompts and personalization data
  • Custom parameters provided for story generation
  • User account information and preferences

1.2. Print License

Storybee hereby grants users a perpetual, worldwide, non-exclusive license to:

a) Order and produce printed versions of AI-generated stories through authorized Print Partners

b) Utilize printed materials for any lawful purpose, including but not limited to:

  • Personal use and enjoyment
  • Commercial distribution and sales
  • Marketing and promotion
  • Public display and performance

c) Create derivative products based on printed materials, subject to restrictions outlined in Section 1.4

1.3. Commercial Rights

Users are expressly permitted to:

a) Monetize printed materials through:

  • Direct sales to consumers
  • Wholesale distribution
  • Online marketplaces
  • Retail establishments

b) Develop commercial enterprises utilizing printed materials, including:

  • Book publishing ventures
  • Educational programs
  • Reading initiatives
  • Merchandising opportunities

c) Establish pricing structures and revenue models at their discretion

1.4. Restrictions and Limitations

Notwithstanding the rights granted herein, users are expressly prohibited from:

a) Claiming ownership or authorship of:

  • Storybee's AI generation system
  • The underlying algorithms and technology
  • Platform features and functionality

b) Modifying or altering:

  • AI-generated content without authorization
  • Storybee's branding elements
  • Attribution notices and disclaimers

c) Engaging in activities that:

  • Violate applicable laws or regulations
  • Infringe upon third-party rights
  • Compromise platform security
  • Manipulate generation systems

2. User Acknowledgments and Warranties

2.1. User Representations

By utilizing the Service, users expressly represent and warrant that:

a) They possess the legal capacity to enter into these terms

b) They understand and acknowledge:

  • The AI-generated nature of the content
  • Storybee's ownership rights
  • Licensing terms and restrictions

c) They will maintain compliance with:

  • Platform policies and guidelines
  • Applicable laws and regulations
  • Third-party service terms

2.2. Content Review Obligations

Users specifically agree to:

a) Review all generated content prior to printing, including:

  • Story narrative and plot
  • Illustrations and visual elements
  • Formatting and layout

b) Verify appropriateness for intended audience

c) Ensure compliance with content guidelines

3. Print Services and Limitations

3.1. Service Description

Print services are provided subject to the following conditions:

a) Production and fulfillment through authorized Print Partners

b) Quality standards maintained by third-party providers

c) Delivery timeframes established by Print Partners

3.2. Quality Assurance

While Storybee strives to ensure quality:

a) Print specifications are subject to:

  • Partner capabilities
  • Material availability
  • Production constraints

b) Color variations may occur due to:

  • Printing processes
  • Material properties
  • Display differences

4. Disclaimer and Liability

4.1. Limited Warranty

THE SERVICE AND PRINT MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

a) MERCHANTABILITY b) FITNESS FOR A PARTICULAR PURPOSE c) NON-INFRINGEMENT

4.2. Limitation of Liability

IN NO EVENT SHALL STORYBEE BE LIABLE FOR:

a) Direct damages exceeding the amount paid for print services

b) Indirect, incidental, special, or consequential damages, including:

  • Lost profits
  • Business interruption
  • Data loss
  • Reputational harm

c) Claims arising from:

  • Print quality issues
  • Delivery delays
  • Content disputes
  • Third-party actions

5. Content Moderation and Compliance

5.1. Review Process

  • All content undergoes AI moderation before printing
  • Storybee reserves the right to reject print orders that:
    • Violate our terms of service
    • Contain inappropriate content
    • Raise potential legal concerns

6. User Responsibilities

Users are responsible for:

  • Reviewing content before ordering prints
  • Using prints in accordance with these terms
  • Complying with all applicable laws

7. Termination

Storybee reserves the right to:

  • Cancel print orders
  • Terminate print services
  • Revoke licenses for violation of terms

8. Governing Law

These terms are governed by Florida law, consistent with our IP Policy

9. Commercial Use

9.1. Commercial Rights Grant

  • Users may commercialize printed materials without additional fees
  • No royalty payments are required for commercial sales
  • Users may set their own pricing for printed materials

9.2. Business Use

Users may:

  • Create business models around printed materials
  • Establish distribution channels
  • Market and promote printed books
  • Generate revenue from sales

9.3. Commercial Limitations

While commercializing, users must:

  • Maintain compliance with all applicable laws
  • Not misrepresent the AI-generated nature of the content
  • Respect Storybee's branding requirements
  • Maintain appropriate records of sales and distribution

10. Severability

If any provision of these terms is found to be unenforceable or invalid:

a) Such provision shall be limited or eliminated to the minimum extent necessary

b) Remaining provisions shall remain in full force and effect

11. Entire Agreement

These terms constitute the entire agreement between users and Storybee regarding print services, superseding all prior agreements and understandings, whether written or oral.
